bulletin board. terry mcsweeney joins us from oakland. the federal monitor talked about the occupy protests. >> reporter: yeah there's a lot in this report, past and present. going forward according to the court appointed monitor oakland pd appears stagnant in its efforts to make reforms and there's evidence perhaps it is going backwards in those everses. take a look at some of the pictures that -- that prplted this report from the court appointed monitor. he says oakland police department's deal with the occupy demonstration show poor police response. he also points at the response to officer-involved shootings as raising greater concerns about the department's ability to change. also troubling says the report an incident at the oakland police department headquarters where pictures of mayor quan and federal judge overseeing the reform and who is blacked were defaced in a manner, according to the internal

affairs department, it called them racist, insulting and inappropriate. the an attorney wants the court to put oakland police department in large part, under the control of the federal government. >> a culture change that they are telling us has taken place has not taken place. and many officers in the oakland police department continue to think that the cultural changes and structural changes we're asking for in the police department are a joke. >> reporter: mayor quan's response to the report "receivership for the oakland police department is not an option we will do everything in our power tone sure highest level of constitutional policing." we have been working hard to make improvements. all of this is the result of the case which took place in 2000 when a group of oakland police officers systematically planted evidence on and beat

suspects in west oakland. changes were ordered then. they are yet to take place. we have asked the oakland police department and police officer's association for a comment. they are yet to get back to us. nick smith is on this case and hopes to have response from pd and the poa by abc7 news at 4:00. terry mcsweeney, abc7 news. a suspect in custody following an attack on a woman near lake merritt. the woman was found unconscious and not brying in the 1500 block of lakeside drive after police received a call after 6:00. investigators say the woman was hit over the head. she was taken to the hospital. police say she alive. they are not releasing details on her condition or who she is. santa rosa police investigating an accident that killed a bicyclist on fountain grove parkway 7:30 this morning. a cyclist was hit traveling west pwoupbld when he was hit by an eastbound car making a

left turn on to thomas avenue. the driver stopped afternoon is cooperating authorities that intersection is expected to reopen at any time. more frustrating delays in the case against the morgan hill man accused murdering 15-year-old sierra lamar. the scheduled arraignment for this morning was postponed, supporters showed up any way they are holding out hope about sierra's fate. amy hollyfield is live in san jose with more. >> reporter: supporters of the lamar family made sure their presence was known here at the courthouse today there were about a dozen people here for the lamar family, friends and volunteers, many of them wearing t-shirts or buttons or carrying posters of sierra lamar's picture on it or her name. the man accused of killing the 15-year-old didn't show up in court. not enter a plea. these advocates didn't seem bothered. they say they are going to keep coming to court and keep looking for the missing girl.

>> the upside, we have more time to find her. to bury him in court. that's what we're gonna do. >> it doesn't matter if i see him or not, just being there, my presence is supporting the family. they are not able to be here. by us being there we are supporting the family. >> that's all that matters. >> reporter: why are you here? >> i'm not sure, i don't think they are emotionally led it. i can't speak for them. >> reporter: the suspect's family was also in the courtroom, including his sister in the black and white shirt. she told us they all strongly believe in his sentence. 21-year-old antolin garcia-torres was arrested two months ago. police say they have dna evidence links him to lamar. garcia fernandez -- garcia-torres got a few attorney who has a lot to go through that explains today's delay. some wouldn't be surprised if it is delayed again. they say this is a big case with a lot of evidence.

right now the next hearing is scheduled august 29th, 2:00 in the afternoon. amy hollyfield, abc7 news. two more san francisco medical marijuana dispensaries are set to close the end of business today because of federal justice department pressure. they've received letters from the u.s. attorney warning of property seizures and prison sentences if the pot clubs did not shutdown. they will be the 7th and 8th dispensaries in they to close under federal pressure. marijuana activists are planning a protest and march to the federal building tomorrow. students in the california state university system may get to attend classes on time after all. csu and faculty reached tentative agreement on a contract that would avert strikes. the instructors voted to authorize a strike in may after working without a contract for two years. this new agreement provides some job stability for

lecturers, no pay raises. the union could reopen talks about pay hikes after the school year. 23,000 professors and lecturers will vote on the contract in late august. mitt romney is on his way back to the united states to boston. this follows an overseas trip overshadowed by controversial comments. katie marzullo has the latest misstep which was not by romney but a vocal campaign aide. >> reporter: his name is rick gorka traveling press secretary. reporters were yelling questions at romney as he left poland's tomb of the unknown soldier. gorka was telling them to back off and let a swear word fly . >> reporter: a half hour after)ó

apple's lawsuit against samsung. the jury was seated yesterday. apple sued samsung last year alleging smartphones and computer tablets are illegal knock offs. apple is demanding 2 1/2 billion dollars in damages. samsung says some of the technology at issue has been industry standard for years. facebook stock hit a new low today, $21.79 this morning a drop of nearly 6%. the drop comes after an analyst report valued the stock between $19 and $23. facebook stock has fallen more than 40% since it began publicly trading in may. wall street analysts speculating starbucks may be interested in buying peet's coffee and tea, they already a billion dollar offer from a german company that could make it one of the most expensive beverage deals in u.s. history. peet's stock has traded 3%

longtime abc correspondent lynn scherr is writing an biography on salary ride. simon and shuster announced the untitled book will have the cooperation of ride's family and her partner of 27 years. the book will offer an extensive look at ride's professional and personal life. her relationship with shaughnessy was not widely known until her death. now the rendition of the national anthem some are calling one of the worst they've ever heard. ♪
